Strategic Relations with the State of Israel and the Fight against Antisemitism

On the basis of historical continuity and the shared destiny of the Kurdish and Jewish nations, the Republic of Kurdistan establishes the legal framework for its strategic relations with the State of Israel and enshrines its commitment to combating antisemitism worldwide.

First: Constitutional Recognition and Strategic Alliance

1.1. The Republic of Kurdistan, on the basis of the legitimate right of nations to self-determination, formally recognises the State of Israel as a sovereign entity on the historical territory of the Jewish nation, as defined by that nation itself and extending to all areas in the vicinity of the territorial boundaries of Kurdistan.

1.2. Relations between the two states shall be founded on a comprehensive strategic alliance aimed at safeguarding national security and sovereignty, and jointly confronting the imperial, occupying and hegemony-seeking forces that threaten both the Kurdish and Jewish nations and the stability of the region as a whole.

Second: The Legal Status of Jewish Kurds and the Right of Return

2.1. The State recognises the constitutional fact that members of the Kurdish nation who adhere to Judaism constitute an indigenous and inseparable part of the Kurdish national fabric.

2.2. All Jewish Kurds who have been separated from Kurdistan by historical circumstances, together with their descendants, possess an unconditional “right of return”; the State shall take legal and administrative measures to formally restore their citizenship of Kurdistan.

2.3. The State shall safeguard the cultural, historical and religious heritage of Kurdistan’s Jewish community and treat it as a protected national asset.

Third: Criminalisation of Antisemitism and Holocaust Denial

3.1. Any form of antisemitic speech, propaganda or action is strictly prohibited in the Republic of Kurdistan and shall be classified as a “hate crime” in violation of the principles of this Constitution.

3.2. Denial or trivialisation of the Holocaust, or any attempt to justify the crime of the Holocaust, shall be deemed a serious crime against the memory of humanity and national security.

3.3. The State shall implement educational programmes to raise awareness among successive generations of the dangers of racial and religious hatred and animosity, as a safeguard for the preservation of social cohesion.

Fourth: Independent Decision-Making and Legal Partnership

4.1. This strategic alliance shall be pursued within a framework of mutual respect for the sovereignty and paramount interests of both nations.

4.2. The Republic of Kurdistan shall maintain its independent foreign policy in its relations with the State of Israel on the basis of mutual respect, and shall make all decisions on international matters in accordance with international law and the country’s strategic objectives.
