Article 2: The National Flag of Kurdistan

The Flag of Kurdistan is the perpetual symbol of the unity, Sovereignty, and Political Identity of the Kurdish Nation, and the perpetual flag of the Kurds and Kurdistan. The Flag of Kurdistan is not merely the flag of the Nation, the Country, and the State of Kurdistan. Every authority and system exercising governing authority in Kurdistan bears a national duty to respect the Flag of Kurdistan and shall have no right to appropriate the National Flag for any ideological doctrine or purpose.

The Flag consists of three horizontal bands: red at the top, white in the centre, and green at the bottom. At the centre of the white band, a golden sun with twenty-one rays shines forth.

First: The Covenant of the Colours

The colours of the Flag of Kurdistan are not merely visible elements; they are the constitutional embodiment of the fundamental and immutable covenants upon which National Being is founded. Each colour represents an ontological duty and a perpetual pledge borne by the State and by every individual member of the Kurdish Nation.

a. The Colour Red: The Covenant of Blood and Nation

The colour red represents the Covenant of Blood: the organic and inseverable bond that binds every Kurd to the past, present, and future of the Kurdish Nation. It symbolises the profound common roots inherited from our forebears through ancestry and entrusted by us, as a sacred charge, to future generations. This Covenant binds the State and the Citizen to:

1. Recognise that the Nation is not merely a collection of individuals, but a living historical continuum bound together by blood and National Memory.

2. Preserve the integrity and continuity of the Nation as the highest ontological duty.

3. Assume collective responsibility for the protection of every individual member of the Nation, for each individual carries a part of this common inheritance.

4. Reject every ideology that seeks to erase this fundamental bond or to portray National Identity as optional or temporary.

b. The Colour White: The Symbol of Light as the Covenant of a Flourishing and Enlightened Collective Life

The colour white represents the highest expression of the Kurdish Nation’s Covenant to build a flourishing and enlightened collective life, animated by an unyielding will and founded upon reason, law, Justice, and the Collective Will for Absolute Sovereignty in Kurdistan as the Country of the Kurdish Nation. It is the Covenant of Purpose: the clear horizon towards which the struggle of the Nation is directed. This Covenant binds the State and the Citizen to:

1. Build a strong State governed by the Rule of Law, in which no person stands above the law.

2. Guarantee Rights and Fundamental Freedoms as the foundation of a life of dignity.

3. Advance Science and Enlightenment and confront ignorance and backwardness.

4. Work without interruption towards an advanced and just society that shall serve as a beacon to the region and the world.

c. The Colour Green: The Covenant of the Territory

The colour green symbolises the inseverable and perpetual Covenant of the Kurdish Nation and its Citizens with the sacred land and Territory of Kurdistan. This is not merely a geographical relationship, but an organic and ontological bond between the Nation and the land that constitutes its physical body and the stage upon which its historical Being is embodied. This Covenant binds the State and the Citizen to:

1. Safeguard, without compromise, the Territorial Integrity of the National Territory as the highest ontological duty.

2. Reconstruct and develop the land as a sacred duty—not merely as an economic resource, but as the realisation of the Nation’s capacities upon its own territorial body.

3. Respect nature and protect the environment of Kurdistan as a legacy entrusted to future generations.

4. Absolutely reject every attempt to alter the demography of the land or to sever even a single span from it, any such act being deemed a betrayal of this Covenant.

Second: The Symbol of the Sun and the Source of National Energy

The golden sun at the centre is the beating heart of the Flag and the symbol of life, knowledge, and the perpetual resurgence of the Nation. It represents the Eternal Energy that binds together the Covenants of Territory, Nation, and Collective Life, transforming them into a living sovereign whole.

2.1. The Energy of the Sun:

a. The energy of the sun gives life to the Territory of Kurdistan—the colour green—and transforms it from lifeless soil into a living Homeland.

b. The energy of the sun warms the blood of the Nation—the colour red—and instils in it the will to defend and to remain united.

c. The rays of the sun illuminate the path towards a flourishing and enlightened Collective Life—the colour white—and define the horizon of the Sovereignty and prosperity of Kurdistan.

2.2. The twenty-one (21) rays signify two foundational historical truths that remain indelible in National Memory:

a. The twenty-first of March—Newroz—as the annual renewal of the Nation’s Covenant with life and resistance.

b. The twenty-first of January 1946, marking the establishment of the Republic of Kurdistan, as the first modern legal and political embodiment of the Nation’s perpetual will for statehood.

Third: Legal and National Status

3.1. The Flag of Kurdistan possesses constitutional status and Absolute Legal Sovereignty, which shall be given effect as follows:

a. As a supreme symbol, the Flag of Kurdistan possesses constitutional status and Absolute Sovereignty in every sphere in which the State is represented, both within Kurdistan and in the international arena.

b. The Flag of Kurdistan shall be raised with dignity upon all official buildings and premises, offices of authority, embassies, and State institutions, and shall fly high and prominently.

c. The presence of the Flag in these places is a legal duty. Its absence shall constitute a constitutional violation and an act of disrespect towards the national sanctities.

d. The Flag is the official symbol of the Armed Forces of the Republic of Kurdistan and shall be displayed with dignity upon military uniforms and at military bases. The raising or display by the Armed Forces of any flag other than the Flag of Kurdistan shall constitute a constitutional violation.

e. The Flag shall be incorporated into the educational curriculum, and respect for it shall be instilled as a supreme value among the new generations of Kurdistan.

Fourth: Crimes against the Flag

4.1. Contempt for the National Flag shall be defined and punished as follows:

a. Any act—whether verbal, symbolic, or physical—that insults, dishonours, desecrates, distorts, or diminishes the dignity or status of the Flag of Kurdistan shall constitute a grave and unforgivable offence against the Sovereignty and dignity of the State and the Kurdish Nation.

b. Crimes against the Flag shall be punished in accordance with the applicable national penal laws.

c. The penalties for such offences may include deprivation of civil rights, imprisonment, or any other severe penalty prescribed by law.

Fifth: The Duty of Protection

5.1. The protection of the Flag of Kurdistan is a public duty and shall be given effect as follows:

a. Protecting and respecting the Flag and upholding its dignity constitute a national duty incumbent upon all Citizens, institutions, and representatives of Kurdistan, wherever in the world they may be.

b. The Flag shall at all times be displayed with dignity and shall never be placed beneath any other symbol. It shall be treated as the most sacred National Symbol, alongside the land and Sovereignty of Kurdistan.

5.2. The procedures governing the raising, lowering, and respectful treatment of the Flag shall be regulated by a Special Law.
